In the modern world Insurance is a necessary part of martial arts for both instructor and student, wether we like it or not . Most of us pay our insurance then quietly forget all about it. But before you forget about it, it is important to understand what your insurance covers. Hence this thread.
Everything you never wanted to know about martial arts insurance but will wish that you did know before you buy a policy or make a claim.
THE PERSON COVERED MAY VARY.
Insuring the actions of the individual student/club member.
Insuring the actions of the individual instructor.
Insuring the business and employees against the actions of other employees.
INSURANCE FOR ORGANISATIONS AND INSTRUCTORS
In the UK there are two principle types of insurance for organisations and instructors. These are public liability insurance and indemnity insurance (definitions from HISCOX WEBSITE 23/11/2016 http://ift.tt/1LfVzYP)
PUBLIC LIABILITY INSURANCE
Public liability insurance covers you for the cost of a claim made by a member of the public that has suffered injury or property damage as a result of your business or a product it has supplied. This means that it protects you against the cost of compensation to be paid out, as well as the legal expenses incurred by the claims process.
This could mean anything from a client or member of the public slipping on a wet floor on your business premises, to tripping over your work equipment when you're visiting them at theirs. It also covers you for damage to property. For example, if a member of the public were to claim you'd broken their laptop whilst visiting them on business, you’d be covered for the cost of compensation owed to them, up to the limit of your policy.
INDEMNITY INSURANCE
Professional indemnity insurance can help protect your business if a client claims that there is a problem with the work you’ve done for them. It can offer cover if you need to pay compensation to correct a mistake or settle a claim, and can also cover your legal defence costs.
Even though you may strive to deliver an impeccable service to your clients, mistakes do happen. A PI insurance policy is designed to protect you against the cost of dealing with a claim from a disgruntled customer. Whether that’s due to a project overrunning or strategic advice that ends up losing a client money, it’s important to ensure you’re covered should an error occur.
For example, you may be faced with paying compensation to a client if they make a claim of:
• negligence – being careless in your work, such as giving bad advice or making a mistake
• infringement of intellectual property rights – for example re-using content from a website without permission
• defamation – making false or damaging claims about a person or organisation
• breach of confidence – sharing confidential or commercially sensitive information without consent.
INSURANCE FOR CLUB MEMBERS/STUDENTS, ALSO KNOWN AS MEMBER TO MEMBER COVER
(Unlike professional liability and indemnity there does not seem to be a formal name for this type of cover). This covers individual club members against injury or loss due to their own actions. E.g. Bob leaves his gym bag on the floor and Fred trips over it resulting in injury.
POLICIES DIFFER IN THE WHAT THEY COVER AND HOW MUCH MONETARY COVER THEY PROVIDE
Although there are three broad types of policy. The specifics of what a policy covers vary with the actual policy. Each policy sets out what it does and does not cover. Each policy also sets out how much money they provide for different sorts of claim.
THERE CAN BE SURPRISING EXCEPTIONS TO THE ACTIVITIES COVERED
Many policies sold in the UK specifically as martial arts insurance do not actually cover martial arts activities. They cover every day activities associated with attending a class. E.g. tripping over a gym bag. But they specifically exclude many of the activities carried out in the class such as striking, throwing, break falling, sparing, etc.
THERE MAY BE CRITERIA THAT MUST BE MET FOR THE POLICY TO BE VALID AND / OR CIRCUMSTANCES THAT INVALIDATE INSURANCE
E.G Instructors may require recognised qualifications and/or continuing professional development. Members may be required tell the instructor pertinent information. e.g. medical conditions that could be affected by activity. Both members and instructors may be required not to be under the influence of drugs or drink.
It is important that policies are not invalidated either by taking a prohibited action or failing to take a required action.
WHAT WE ALL NEED TO KNOW ABOUT INSURANCE.
It is important to know what activities are covered, for how much, and to make sure that insurance is not invalidated in some way
